Summary
Currently the REC does not require the Central Switching Service (CSS) and Switching Operator (SO) to provide the enduring test environments and test data for use by REC Parties when making necessary system changes for REC Change Proposals or internal system updates. This Change Proposal has been raised to introduce these obligations in to the REC.

Problem Statement
For specific types of changes, industry system testing will be required to ensure the end-to-end Switching processes will work as expected following implementation. If Test Environments and Test Data are not available, CSS Users will not be able to complete testing to confirm their systems will operate correctly in the live environment. The REC currently doesn’t define specific obligations on Service Providers regarding enduring test systems and Test Data for Switching processes. The lack of specific obligations may impact the availability of appropriate Test Environments. This could impact the progression of improvements to Switching processes that require a technical change.

Latest Update
19/03/2024 - Following further analysis and engagement with the REC Change Panel at its meeting on 19 March 2024, the Code Manager has revisited its consideration of this Change Proposal. Despite earlier acceptance of the Change Proposal, the Code Manager, and the Change Panel, believes that the proposal has no reasonable prospect of being approved in its current format, and have determined that the Change Proposal should not progress any further. Consequently, Change Proposal R0068 has been rejected. The Code Manager has offered their assistance to the proposer should they need any support in raising a new Change Proposal to resolve any remaining issues.
Summary
A number of additional data protection related changes were identified during the progression of Change Proposal R0046A ‘Governance of Data under the REC (Alternative)’. The intent of this Proposal is to collate all remaining proposed changes, to assess and progress them independently of R0046A, to allow for more thorough industry consultation and with longer lead-times to implementation.

Latest Update
28/06/2024 - Change implemented as part of the June 2024 REC Release
Summary
This Change Proposal seeks to clarify the obligations of each type of metering provider by reintroducing the distinction between Meter Operator Agents and MOCOPA Meter Installers which was removed by Retail Code Consolidation. At Retail Code Consolidation these organisations were merged into a new category, Metering Equipment Managers, which also included gas metering providers. Whilst both types of organisation can provide metering services, not all MEM obligations in the REC apply to both organisations.

Proposed solution summary
  1. As an electricity MEM, I want to be clear on the obligations I need to meet, based on the type of metering activity I complete. I want to meet my obligations efficiently and effectively and without the need to seek additional input/advice from the Code Manager.
  2. As the Code Manager, I want to be able to differentiate between electricity MEMs based on the type of activity they are responsible for and their interaction with central systems, so that I can engage appropriately. I need to be clear on the obligations that each MEM should be meeting and the performance reporting that should be provided.

Problem Statement
The REC currently groups all electricity metering providers within the MEM category. Previously, under the Master Registration Agreement (MRA) they were either classified as Meter Operator Agent or MOCOPA Meter Installers. Not all MEM obligations in the REC are intended to apply to both types of organisations. This can result in ambiguity on the obligations set out in the REC that need to be met by the different types of electricity MEM, not being able to target information to REC Parties appropriately and MEMs not being clear on their new entrant or Maintenance of Qualification obligations.

Latest Update
This change was implemented on 12 April 2024. *This change is expected to have a direct impact on the Market-wide Half Hourly Settlement Design for it to be maintained in the enduring arrangements. The change has been approved as it has value for the interim period.*
Summary
As part of the Faster Switching Programme Enactment Phase change CR-E37, a restriction was applied to Electricity Retail Data Agents (ERDAs) to prevent multiple changes being made to the RMP. Any errors can be rectified once in the lifetime of an RMP, back to the creation of the RMP. This change has been raised to allow ERDAs to make more than one change to Energy Flow to improve data accuracy without requiring a new RMP

Proposed solution summary
  1. As a Consumer, I want any metering data issues to be resolved without the need for a new MPAN to be created, so that I am able to reference my current MPAN in any discussions with my Energy Supplier or other Market Participants.

Problem Statement
To maintain accurate values for Settlement, DNOs must make regular changes to the LLFC Indicator in ERDS. Until June 2023, the meteringPointEnergyFlow has been tied to this Data Item, which has sometimes resulted in changes to the energy direction. For example, going from Import to Export. Where errors have been identified, the DNO needs to be able to correct meteringPointEnergyFlow back to the correct value to ensure data accuracy. The current restriction, to only one change of Energy Direction against an RMP, can be overcome through by terminating the existing RMP and creating a new RMP with the correct Metering Point Energy Flow value. This has a detrimental impact on the Consumer and Settlement. It is inconvenient for the Consumer to be assigned a new MPAN and Settlement relies on an accurate history that will be lost when a new MPAN is assigned.

Latest Update
04/08/2023 - Change Proposal has been withdrawn as agreed with the Proposer. The Problem Statement was addressed through C3-0047 - Updates to PAB Procedures.
Summary
Within Schedule 19 – Market Exit and Supplier of Last Resort there is currently no consideration of circumstances where the Replacement Supplier is unable to fulfil its REC obligations in respect of Consumers transferred to them, due to them having little or no control over the processes of the failed supplier or it’s administrator. This change seeks to define when the Replacement Supplier is responsible for obligations relating to the Consumers gained through a Supplier of Last Resort (SoLR) Process.

  1. As a Consumer when my Energy Supplier goes out of business and I am transferred to a Replacement Supplier, I want my supply transfer to be handled quickly and have confidence that my new Supplier has all the necessary data to set up my account and bill me correctly from the transfer date, and if the Replacement Supplier fails to provide the expected level of service they will be appropriately held accountable.
  2. As a Replacement Supplier, I want the limitations affecting my ability to meet my REC obligations to be understood by the REC Code Manager and the Performance Assurance Board, so that any breaches of obligations are considered fairly and any limitations are taken into consideration.
  3. As the Code Manager I want to apply appropriate and proportionate Performance Assurance Techniques, taking in to account the ability of a Replacement Supplier to meet their obligations under the REC.

Problem Statement
Currently, Replacement Suppliers are responsible for all obligations of the failed supplier from the date and time set out in the Last Resort Supply Direction, this includes a period of time prior to Consumer accounts transferring to the Replacement Supplier’s systems, limiting their ability to fulfil these obligations. This means that a Replacement Supplier may experience issues with the Performance Assurance obligations for which they are responsible, but do not have direct control over. Any breaches of obligations by a Replacement Supplier need to be considered fairly and any limitations the Replacement Supplier may face are taken into consideration.

Proposed solution summary
  1. As an Energy Consumer, I want my metering fault to be identified and fixed as soon as possible, so that I am not left in a situation where I have no electricity for an extended period. I want to be able to contact the correct Party to fix my metering fault. I want my personal circumstances to be taken in to account when arranging for a fault to be fixed out of standard working hours.
  2. As a DNO, where there is a meter fault identified I want to be able to contact the Energy Supplier to rectify this, no matter what day or time this is identified, so that Consumers are not left without power for extended periods, during which time they may require ongoing help, support and communication. As an Energy Supplier, I want to provide my Customers with accurate and relevant Emergency contact information. As an Energy Supplier, I want to be able to respond to meter faults in a timely manner and not leave Consumers without power for an extended period.
  3. As a MEM, I want to be notified, in a timely manner, of faults that occur on Metering assets I am responsible for, so that I am able to rectify these without undue detriment being experienced by Consumers
Problem Statement
In situations where an Electricity Consumer experiences a loss of power, the DNOs who attend site to investigate and resolve the issues, are unable to do so when there is a meter issue, which is the responsibility of the Energy Supplier and it’s Appointed agents. When an issue occurs out of hours, or when an Energy Supplier does not have an out of hours metering service in operation, Consumers can be left without power for an extended period, this can create a safety or health concern, particularly for vulnerable Consumers or vulnerable members of their household.

  1. As a Consumer, I want to have the confidence that my data is being handled compliantly in accordance with the UK GDPR.
  2. As a REC Party, I want to achieve compliance and have clarification on my obligations in the context of REC Services.
  3. As a REC Party/Service User, I want to understand the reporting obligations I need to meet if the event of a Personal Data Breach relating to REC Data, to ensure that RECCo Board is made aware. As a REC Party/Service User, I need to understand that I will still need to independently assess and document my respective data protection roles under the REC. As a REC Party/Service User, I need to understand the roles and responsibilities of a Data Controller and/or Data Processor to be able to carry out my obligations under the REC.

Problem Statement
The current data protection and governance provisions in the REC are not fit for purpose, having the potential for ambiguity. Changes have been identified, following a legal review, which will provide more clarity for REC Parties who are Data Controllers and/or Data Processors, and to enable RECCo to maintain a comprehensive approach to the governance of data under the REC.

Latest Update
08/11/2024 - This Change Proposal has been implemented as part of the November 2024 REC Release.
Summary
The Central Registration Services (CRS) intellectual property rights (IPR) provisions in the Code were drafted before designation of v1.0 of the Code and primarily seek to deal with the CRS Services IPR as if it were IPR developed and owned by the CRS Provider or its contractors. In reality, much of the solution is built upon third party-owned software or platforms/services that are available to the market. Notwithstanding certain concessions were drafted in Clause 13.5 of the Code at designation, the scope of CRS Service IPR refers to some now obsolete terms and concepts and ought to be amended to clarify what the CRS Provider actually owns or is responsible for, to alleviate the existing ambiguity. Potential to amend Clause 13 of the Code as proposed in the attached mark-up, with consequential amendments to the associated definitions in Schedule 1 (Interpretation and Definitions). The definition “User” should be deleted from the Code and the defined terms “CSS User” or “REC Service User” (as applicable) used in substitution.

Problem Statement
There is uncertainty as to the scope of the various classes of Intellectual Property Rights (IPR) covered in Clause 13 of the REC Main Body (including the extent to which any IPR may exist in certain data, and the use of obsolete terms and concepts). As a result, there is a risk that the relevant industry stakeholders referred to in Clause 13 are unable to grant the licences and indemnities as described in that Clause. The current wording of Clause 5.3 of the REC Main Body requires amendments to ensure it correctly reflects the relationship between CRS Provider and RECCo, the services being provided and the entitlement to input VAT as a recipient of the CRS.
