  1. As a REC Party, I need the REC drafting to be accurate, so I can rely on it to ensure my processes and procedures correctly reflect my obligations. If there are mistakes or omissions, then it could cause issues with the effective operation and assurance of the retail energy market.

Problem Statement
REC Parties and Service Providers rely on the REC to provide a consistent baseline to ensure the industry operates effectively and to give certainty to Parties obligations. There are currently inconsistencies between the drafting of the REC, and the processes operated by REC Parties and Service Providers. This could cause issues in the effective operation and assurance of the retail energy market.

Summary
Change Proposal R0034 seeks to give effect to the Market Stabilisation Charge through the introduction a new Market Stabilisation Charge Schedule, to allow for the effective discharge of the new licence obligation to place obligations on RECCo and Energy Suppliers. Consequently, a new definition for the MSC will need to be added to the Interpretations and Definitions Schedule, and the introduction of a new REC Schedule will require an update to the REC Baseline Statement. This Category 3 CP has been raised to progress the updates to the REC Baseline statement - implementation of the changes will be progressed and managed as part of the Release Plan and activity for R0034

Proposed solution summary
  1. As a Domestic Consumer, I want to be able to choose my Energy Supplier and a tariff from a range of competitive options, so that I can take advantage of cheaper deals as they become available.
  2. As the Authority, I want the necessary changes made to the Retail Energy Code to introduce the MSC obligations, so that the new MSC licence obligations on Energy Suppliers can be effectively discharged by RECCo.
  3. As RECCo, I want the Retail Energy Code to specify my obligations, governance and charging mechanisms, so that I can effectively discharge obligations imposed by the Authority through the Licence Condition modification.
  4. As a Domestic Supplier, I want to understand how RECCo will calculate my credits and liabilities and when they will send my invoices/credit notes, so that I can plan to review my invoices/credit notes prior to the receipt of monies owed or payments I make to RECCo or at an appropriate time for my organisation. As a Domestic Supplier, I want to understand how I could dispute an invoice which I do not believe is accurate, so that I am able to raise a dispute/challenge compliantly

Problem Statement
Following the publication of Ofgem’s decision on potential short-term interventions to address risks to consumers from market volatility, the Market Stabilisation Charge will be introduced via the modified Standard Licence Condition 24A and introduced into the REC by Change Proposal R0034. A change is needed to the REC to set out the charging and payment mechanism, and to introduce the necessary governance arrangements to allow these MSC payments to be administered by RECCo.

  1. As a Micro-Business Consumer, I want my Energy Supplier to complete my Smart Meter installation in line with, or above, the standards of service provided by other Energy Suppliers, so that the installation of the Smart Meter has minimal disruption to my business.
  2. As an Energy Supplier to Micro-Business Consumers, I want access to Consumer feedback from across the industry, to enable me to assess my performance relative to other Micro-Business Energy Suppliers and identify areas of under or over performance, enabling me to take appropriate actions to increase or maintain my performance.

Problem Statement
Energy Suppliers do not currently have the ability to assess their Micro-Business Smart Meter installation performance relative to other Energy Suppliers through Consumer Survey Reports, therefore may not take any appropriate action to address any areas of underperformance or respond to trends in Consumer feedback, wider than their own Consumer base. This could affect the Smart Meter installation service received by Micro-Business Consumers.

Proposed solution summary
  1. As an impacted Market Participant, I want to ensure good quality underlying data is available to support the transition to HH Settlements to avoid additional time and effort being spent fixing data quality issues during the migration period.
  2. As the MHHS Programme, I want Registration Data Items to be available ahead of the MHHS migration to enable data cleanse activity to be completed to address data quality issues.

Problem Statement
There are Registration Service Data Items that are critical to the MHHS rules and processes. The MHHS Programme is concerned that starting migration in October 2024 with poor underlying data quality would lead to avoidable time and effort being spent fixing issues during the 12-month migration period. To facilitate MHHS Programme data cleanse activity, prior to the transition to Half Hourly Settlement, Registration Service Data Items need to be introduced into the existing Supplier Meter Registration Service (SMRS) system and displayed in EES.

Proposed solution summary
  1. As the DNO, I only want to send the commissioning information using the D0383 (MM00370) when I am made aware that the site has now been energised by the Registered Supplier’s MEM for a CT Pre-commissioned meter, so that I can meet my regulatory obligations under the BSC
  2. As a MEM I want to receive the information from the DNO in a timely manner to ensure my records are accurate and up to date, and that I can provide the Registered Supplier with information to ensure the metering point is accurately settled.

Problem Statement
The Balancing & Settlement Code Procedure (BSCP) 515 and the Retail Energy Code (REC) Metering Operations Schedule set out the obligations and timescales imposed on the DNO to send commissioning information to the MEM (using the D0383 (MM00370) data flow), where the DNO has installed metering equipment, with Measurement Transformers. When the DNO installs Low Voltage Current Transformer (LV CT) metering units, that have been pre-commissioned off-site, the commissioning of the units is done before installation and separately to the Energisation of the Supply. When the Energisation status change is the responsibility of the Registered Supplier and is requested of the MEM using the D0134 data flow, notification of the change in energisation status is then sent to the Registered Supplier and the DNO by the MEM, using the D0139 (MM00036) For an LV fused supply, the DNO may not be aware of who the MEM is to send the commissioning information to via a D0383 (MM00370) until a D0139 (MM00036) is received. This is often the point at which the DNO first becomes aware that a fused supply is now Energised. This may be several days/weeks/months after DNO commissioning, and it is proving difficult for the DNO to meet their BSC obligations.

Proposed solution summary
  1. As a Consumer I want to receive my bills when expected, from the Supplier of my choice without delays caused by being switched incorrectly and not being resolved in a timely manner. As a Consumer, in the event that my Supplier has exited the market and my supply cannot be returned to my original Supplier, I want the Gaining ET Supplier to have the ability to terminate any ET process that has already been initiated so that I am able to choose my preferred Supplier and switch without delay or penalty.
  2. As a Consumer, if Energy Suppliers need to share my data to resolve a switching issue, I want Suppliers to share my personal data securely so that my data is protected.
  3. As an Energy Supplier, where appropriate, I need to be able to cancel an ET effectively and efficiently, so that I can bill my Consumers accurately and timely. As an Energy Supplier, where appropriate, I need to be able to cancel an ET so that I supply Consumers with whom I have a valid contract.
  4. As The Code Manager I need to be able to identify when an ET has been cancelled so that I have a clear audit trail and can monitor performance effectively.

Problem Statement
Erroneous Transfers are being cancelled by Suppliers, which is currently not permitted under the REC. There is no consistent defined process or audit trail. In the event of a Supplier of Last Resort (SoLR) being appointed, or on a Change of Occupier at a premise, the Gaining Supplier currently has no way to formally cancel an ET after it has been initiated. This can cause Switching and/or Billing delays for Consumers whilst Energy Suppliers attempt to resolve an outstanding or open ET. For Energy Suppliers this can mean they are supplying Consumers with whom they have no Valid Contract, resulting in additional Guaranteed Standards of Performance (GSOP) Payments and increased Consumer dissatisfaction. The Performance Assurance Board (PAB) has no way to identify the difference between the process legitimately closing without resolution, and an Energy Supplier not meeting their obligations in the code to properly resolve an ET. As a result, the PAB are unable to differentiate the performance of Energy Suppliers between those that are closed down legitimately or those being closed inappropriately.
