Summary
Performance Assurance activities are either specified in the Code (such as Maintenance of Qualification) or areas identified as priorities for the PAB in the Retail Risk Register. In mobilising for REC V2, the Code Manager completed a risk assessment of the REC V2 schedules along with the REC V3 schedules available at the time. REC V3 covers processes that will operate after CSS go-live, and therefore some schedules are fundamentally different to REC V2, whereas others are unaffected. ************We are currently measuring 27 out of the original 56 identified Risk Drivers. The 29 remainder Risk Drivers have not been measured to date for the following reasons: ****For 3 drivers we are in the process of gathering data, primarily from Prepayment Infrastructure Providers (PPMIPs). ****For 12 drivers relating to prepayment performance we are conducting additional work to determine the optimal way to measure these Risk Drivers. ****The remaining current 14 Risk Drivers relate to relevant measures post-CSS, and will therefore start to be measured and monitored after CSS go-live. *************The proposed changes that have been made to the Retail Risk Register include updates to 16 Risk Drivers, either improving the description or moving them to a more appropriate Risk. A more detailed description of the changes is available in the updates to the REC Retail Risk Register document

Proposed solution summary
- As a Market Participant, I need the industry Market Message/Data Specification to be implemented by all Parties at the same time so that I am able to validate EMRS invoices and credits without having to request additional supporting data or without my Market Messages failing.
- As LCCC I need to delay the implementation of R0011 so that changes to industry Market Message/Data Specification can be implemented by all Parties at the same time so that industry Market Messages don’t fail validation between Parties.
Problem Statement
Following a review of its delivery pipeline, the LCCC has determined it is unable to deploy the changes required in time for the current approved implementation date of 04 November 2022. In order to communicate a revised date and to limit the impacts to industry parties and delivery partners, this change needs to be assessed as a matter of urgency.

Problem Statement
Following the implementation of REC V3.0, the Code Manager (Performance Assurance) will need to receive the data necessary for them to complete their Performance Assurance activities post REC V3.0 The Performance Assurance Report Catalogue requires a change to include the new and updated Data Items. These are required to support the monitoring of Retail Risks included in the revised Performance Assurance Risk Register and give REC Parties clarity on the data they are required to provide.

Problem Statement
The way debt is transferred for prepayment Consumers is neither fit for purpose nor Consumer-centric and there is currently no mechanism to transfer credit balances when a Switch occurs. The Debt Assignment Protocol (DAP) process is complex and cumbersome. Despite automation and streamlining implemented in 2019, DAP is not being used to the extent that it was designed for. Domestic Consumers with legacy Prepayment Meters or Smart Meters in prepayment mode are disadvantaged in their ability to actively engage in the market which is believed to be due to the complexity of DAP. The DAP process was not designed for, nor has it been reviewed, to specifically consider Smart Meters. Consumers with Smart Meters operating in prepayment mode currently have any credit (calculated at the Switch date) refunded to them by the Losing Supplier. A refund can take up to 2 weeks after the final account position is determined - which can be up to 6 weeks after the Switch itself. The Consumer must top up the meter with the Gaining Supplier once the Switch has completed. This creates a cashflow issue for Consumers, including vulnerable Consumers, which may be seen as unnecessary. It is detrimental to Consumers to have credit removed from the meter. Under the current economic conditions, with the associated increasing energy prices, it is imperative that Consumers, particularly vulnerable Consumers, have access to their money rather than needing to top up again to cover the energy used during the Losing Supplier’s refund process or if required seek support from their new Supplier. In addition, across debt and credit neither balance transfer process has been reviewed in consideration of the faster more reliable switching requirements. There is therefore a need to review the balance transfer processes in full, with a view to developing an agile, efficient, Consumer-centric solution for smart and with aligned improvements to the non-smart processes.

- As a REC Party, I need the REC drafting to be accurate, so I can rely on it to ensure my processes and procedures correctly reflect my obligations. If there are mistakes or omissions, then it could cause issues with the effective operation and assurance of the retail energy market.

Problem Statement
REC Parties and Service Providers rely on the REC to provide a consistent baseline to ensure the industry operates effectively and to give certainty to Parties obligations. There are currently inconsistencies between the drafting of the REC, and the processes operated by REC Parties and Service Providers. This could cause issues in the effective operation and assurance of the retail energy market.

Summary
Change Proposal R0034 seeks to give effect to the Market Stabilisation Charge through the introduction a new Market Stabilisation Charge Schedule, to allow for the effective discharge of the new licence obligation to place obligations on RECCo and Energy Suppliers. Consequently, a new definition for the MSC will need to be added to the Interpretations and Definitions Schedule, and the introduction of a new REC Schedule will require an update to the REC Baseline Statement. This Category 3 CP has been raised to progress the updates to the REC Baseline statement - implementation of the changes will be progressed and managed as part of the Release Plan and activity for R0034

Proposed solution summary
- As a Domestic Consumer, I want to be able to choose my Energy Supplier and a tariff from a range of competitive options, so that I can take advantage of cheaper deals as they become available.
- As the Authority, I want the necessary changes made to the Retail Energy Code to introduce the MSC obligations, so that the new MSC licence obligations on Energy Suppliers can be effectively discharged by RECCo.
- As RECCo, I want the Retail Energy Code to specify my obligations, governance and charging mechanisms, so that I can effectively discharge obligations imposed by the Authority through the Licence Condition modification.
- As a Domestic Supplier, I want to understand how RECCo will calculate my credits and liabilities and when they will send my invoices/credit notes, so that I can plan to review my invoices/credit notes prior to the receipt of monies owed or payments I make to RECCo or at an appropriate time for my organisation. As a Domestic Supplier, I want to understand how I could dispute an invoice which I do not believe is accurate, so that I am able to raise a dispute/challenge compliantly

Problem Statement
Following the publication of Ofgem’s decision on potential short-term interventions to address risks to consumers from market volatility, the Market Stabilisation Charge will be introduced via the modified Standard Licence Condition 24A and introduced into the REC by Change Proposal R0034. A change is needed to the REC to set out the charging and payment mechanism, and to introduce the necessary governance arrangements to allow these MSC payments to be administered by RECCo.
